Judge Dismisses Tyre Casino Lawsuit

A judge has dismissed a lawsuit filed by residents against plans to bring a casino to the Seneca County Town of Tyre.

57 residents took the town board to court for their support of the project.

Rochester-based Wilmorite is competing for the Southern Tier casino license by proposing a casino in a narrow strip of the region that extends through the Finger Lakes up to Lake Ontario midway between Rochester and Syracuse.

Residents accused the board of changing zoning laws specifically for the casino without properly consulting the local population.

The judge dismissed the case claiming that the residents could not prove that the changes were directly linked to the casino.

An attorney for the plaintiffs says he plans to appeal.
