DA: Man found guilty of burglarizing dead man's apartment

BINGHAMTON, N.Y. - UPDATE: The DA's Office has clarified their original release by saying the body of the dead man had been removed from the apartment shortly before the burglary, and that it was not present at the time of the burglary.

A Broome County Jury has found a man guilty of burglarizing the apartment of a deceased man.

A release from Broome County District Attorney Steve Cornwell's office says Gerald Porter, 61, was found guilty on Thursday of Burglary in the 2nd degree, a Class C Felony, and Criminal Possession of Stolen Property in the 5th degree, a Class A Misdemeanor. 

Porter burglarized the apartment of a dead man on the west side of Binghamton on August 23, 2016.

Because Porter is a second violent offender, he faces 7-15 years in New York State Prison, according to Cornwell's office.

He is scheduled to be sentenced in September.
